Welcome to Tutorly. These Terms of Service ("Terms") govern your use of the Tutorly mobile application (the "App") and any related services (together, the "Service"). The Service is operated by Sana Malik, a sole trader based in the United Kingdom ("we", "us", "our").

By using Tutorly, you agree to these Terms. If you do not agree, please do not use the App.

1. The Service

Tutorly provides an AI-powered voice tutoring assistant ("Hoot") that students can converse with for learning support. The AI is provided by OpenAI's Realtime API and operates entirely through voice conversation.

Important: Tutorly is an educational support tool. It is not a replacement for qualified human teachers, accredited education, or professional advice. The AI may occasionally produce incorrect or incomplete information. You should verify important information from authoritative sources.

2. Eligibility

You must be at least 13 years old to use Tutorly. Users between 13 and 16 should have parental or guardian consent. By using the Service, you represent that you meet this age requirement.

3. Your account

You sign in using Sign in with Apple. You are responsible for maintaining the security of your Apple ID. Notify us immediately at tutorlyAI_app@outlook.com if you suspect unauthorised use of your account.

4. Free trial, Free tier, and Pro subscription

Free trial: When you create a new account, you receive a 7-day free trial with the following daily limits:

We reserve the right to suspend or terminate accounts that violate these rules.

7. Intellectual property

The App, including the Tutorly name, the Hoot mascot, design, code, and content, is owned by Sana Malik and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute the App or its assets without our written permission.

You retain rights to any educational content (text, voice) you create during your use of the Service.

8. Third-party services

The Service relies on third-party providers, primarily OpenAI for AI processing and Apple for authentication and payments. Their respective terms and privacy policies apply to your use of those services. We are not responsible for the actions, policies, or downtime of third-party providers.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of AI-generated information.

We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the Service at any time without notice.

10. Limitation of liability

To the fullest extent permitted by law, Sana Malik will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim arising out of these Terms or your use of the Service is limited to the amount you paid us in the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms or your misuse of the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may terminate your account if you violate these Terms or if we discontinue the Service.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the App or by email. Continued use after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.
